TERMS AND CONDITIONS
SPECIAL CONDITIONS
- Build Report Pty Ltd reserves the right to reject any application at its absolute discretion. If an application is rejected, any fees, deposits, or other monies paid by the client will be refunded in full.
- Build Report Pty Ltd shall not be liable for failure to perform any duty or obligation under this agreement where such failure is caused by factors outside its reasonable control, including but not limited to inclement weather, industrial disturbances, unavoidable accidents, inability to obtain labor or transportation, or other unforeseen circumstances.
SCOPE OF INSPECTION AND REPORT
A Standard Property Inspection Report provided by Build Report Pty Ltd addresses the detection or non-detection of:
- Structural Damage
- Conditions Conducive to Structural Damage
- Any Significant Defects in the general condition of Secondary and Finishing Elements of Construction that are discernible at the time of inspection, with or without ancillary testing.
All other inspections are classified as Special-Purpose Inspection Reports.
The inspection and report will be based solely on the following, as specified by the client:
- Option 1: A 'visual only' examination of surface work (see Limitations below).
- Option 2: A visual examination of surface work combined with Tests.
- Option 3: A customized inspection report that may include Options 1 or 2, as well as additional client-specific requirements attached to this document.
Note: For strata or company title properties, the inspection is limited to the interior and immediate exterior of the specified unit. Common property areas may require a separate Special-Purpose Inspection Report.
LIMITATIONS
The client acknowledges and agrees to the following limitations:
- A ‘visual only’ inspection may have limited value. Thorough inspections of accessible areas may require the use of appropriate tests.
- The report does not include items or matters outside the scope of the requested inspection. Additional items may require a Special-Purpose Inspection Report.
- The report excludes matters outside the expertise of the consultant.
- The inspection only covers Readily Accessible Areas. Areas that are inaccessible or obstructed at the time of inspection (e.g., fixed ceilings, floor coverings, furniture, stored items, vegetation, etc.) are not included.
- A Standard Property Inspection Report is not a warranty or an insurance policy against future issues.
- The report is prepared exclusively for the client named in this agreement. Build Report Pty Ltd is not responsible for reliance by any third party.
EXCLUSIONS
A Standard Property Inspection Report does not cover:
- Minor faults or defects that do not require significant repairs or urgent attention.
- Solutions or cost estimations for rectification or repair work.
- The structural design or adequacy of construction elements.
- Detection of wood-destroying insects (e.g., termites, borers).
- Operation of fireplaces and chimneys.
- Services including electrical, plumbing, fire detection, or mechanical systems.
- Pools, spas, and associated equipment.
- Appliances (e.g., dishwashers, ovens).
- Occupational health and safety issues (e.g., asbestos, safety glass, pool fencing).
- Compliance with building codes, regulations, or by-laws.
- Ground conditions, such as subsidence, landslip, tidal inundation, or flooding.
The above may be included in a Special-Purpose Inspection Report by an appropriately qualified inspector.
DEFINITIONS
- Structural Damage: Significant impairment of the building’s load-bearing capacity, including cracking, deformation, or dampness.
- Conditions Conducive to Structural Damage: Factors that may contribute to structural issues.
- Primary Elements: Load-bearing parts of the building (e.g., foundations, walls).
- Secondary Elements: Non-load-bearing parts of the building (e.g., linings, partitions).
- Finishing Elements: Fixtures and finishes (e.g., tiles, paint).
- Readily Accessible Areas: Areas that can be inspected without risk to the consultant or property.
PAYMENTS
- All reports remain the property of Build Report Pty Ltd until full payment is received.
- Payment is due upon completion of the inspection or as per the agreed terms.
- Accepted payment methods: Cash, cheque, direct debit, or major credit cards.

- Credit card payments may be automatically debited upon completion of the inspection.
- Overdue accounts (60+ days) will incur interest and administration fees.
- Outstanding amounts referred to a collection agency will include recovery costs.
- Cancellations must be made at least 24 hours prior to the inspection, or a cancellation fee will apply.
- By paying the agreed fee, the client acknowledges that they have read, understood, and agreed to these terms and conditions.
